WARRANTY INFORMATION
Pondliners.com warrants to the purchaser of the pondliners,
subject to the conditions and limitations stated herein, that
the Pondliners liner shall maintain its manufactured integrity
with its physical characteristics for a period of 20 years
for the 45 and 60 mil Pondliners EPDM liner. The warranty
date will commence from the date of purchase.
Others claim a 20-year warranty, but read the fine print!
Conditions of Warranty
Pondliners.com shall have no obligation to repair or replace
the product under this warranty unless the following conditions
have been met or exceeded:
1. Written notice is provided to Pondliners.com
of any failure or possible failure within 30 days.
2. The product is installed under the standard guidelines
of pondliner installations.
3. Full payment for all product, warranty, or any other related
fees or costs have been received by Pondliners.
4. All alterations (splicing, cutting, repairs) made to the
Pondliners pondliner have been approved by Pondliners prior.
Liabilities Excluded from this Warranty
A. Pondliners shall be held harmless for any
damage to property, or any and all costs associated to the
installation or removal of the Pondliners pondliner including
but not limited to; loss of pondlife or supposed sickness
of any and all pond life and for any incidental or consequential
damages related to the use or misuse of any Pondliners product,
since Pondliners has no control over the installation or handling
of the pondliner products by the consumer.
B. Pondliners shall have no responsibility for monetary claims
related to sickness or death of any pond life.
C. Pondliners assumes no responsibility for failure of components,
products, or materials not furnished by Pondliners.
D. The Pond Owner, and/or Installer and all other parties
with an interest in the Pondliners pondliner agree that apart
from the remedies provided in this warranty, said parties
waive any and all other claims, actions or demands related
to the use of the Pondliners products.
Refunds or Replacements
If the Pondliners Pondliner fails to perform
as warranted herein after a reasonable attempt on the part
of Pondliners to remedy such failure, Pondliners will furnish
new product at no cost to the owner, or Pondliners will refund
to the owner, the purchaser’s original cost of the product,
Pondliners shall have no other obligations or liability hereunder.
No Other Expressed Warranty
No other warranty, expressed or implied, is
hereby given, and no affirmation by Pondliners or its agents
by word or otherwise so constitute any other warranty.
